In Ukraine, there is no guardianship authorities for children, who have left Donbas

During the past year and a half, Ukrainian legislation provisions do not define the guardianship authorities for children, who have left uncontrolled territories of Donbas. It was stated by Elena Petryayeva – the head of community initiative «Restoring Donbas» – during the interview on radio «Vesti».
According to her, such situation has already touched on foster families and family-type homes, which moved to other countries. Moreover, in the subsequent, it will touch those families, who have remained on Ukrainian territory.
“We have submitted requests from the foster parents of children’s homes of family type, who have moved to other states due to the beginning of the hostilities. They want to return to Ukraine, but, unfortunately, they do not know where to go, where will they live and what to feed their children. The government, which must ensure quality control of bringing up children in such families and their education, has abstracted from the solution of this problem, “- said Elena Petryayeva.
According to the head of the initiative, the problem is in the fact that the guardianship authorities in Ukraine are operating on a territorial basis. Therefore, for instance, the guardianship authority in Cherkassy region can not affect the decisions, which were taken by the same authority in Donetsk region. Consequently, orphans and children deprived of parental care, who have left Donbas, can not get benefits, which are provided by law. There is no system of output of children from families of guardians and family-type homes, for instance, on reaching the age. As well as the system for admitting new children in these families. Such decisions were made by executive committees, regional state administrations, which are not operating on the uncontrolled territories today. Thus, the state does not carry out proper control over the maintenance and education of these children.
There is even worse situation with foster families and family-type children’s homes, which left Ukraine. Thus, according to the initiative, only on the territory of the Russian Federation there are five family-type homes (32 children) and 12 foster families (18 children). These fifty children are Ukrainians. In fact, the state has refused from them despite the Art. 56 of the Constitution of Ukraine (the responsibility for the education of orphans).
According to Elena Petryayeva – the head of community initiative – in order to resolve this problem, when children are residing on Ukrainian territory, the Cabinet of Ministers of Ukraine has to legalize the status of the guardianship and custody of local authorities, where they are living today. In addition, it is necessary to oblige the Ministry of Social Policy to coordinate the work on the return of families and children, who have left the country, to Ukraine. It should provide such families with maximum information and social support. Community initiative «Restoring Donbas» is able to assist.
