Cabinet of Ministers has limited the rights of IDPs by its regulation – experts of “Restoring Donbas”

The Cabinet of Ministers of Ukraine has complicated the possibility of exercising legitimate rights by IDPs from the ATO area. Such conclusions were made by lawyers of the community initiative “Restoring Donbas” based on the analysis of government regulations, obliging IDPs to put a Migration Service stamp on their certificates of residence.
Resolution suggests that now IDPs’ certificates (both issued at the moment, and those that will be issued in future) are valid only if they have a stamp of the territorial division of the State Migration Service.
Moreover, it is envisaged that the staff of the Migration Service, together with the police will check – whether a displaced person lives at the address, specified in the certificate. If an IDP is not available at the specified address, the decision will be made to cancel the certificate.
It is important, at the same time the Cabinet of Ministers does not regulate exactly how and at what time IDPs’ addresses will be checked. Employees of government agencies can come to IDPs during the time when they are at work, draw up a statement of their absence and send documents for the abolition of certificate. Thus, an IDP will lose his right even to those minimal social guarantees, provided by law.
It should be noted that this is not directly provided for by the law, and one can say that the government has exceed its authority by taking such a decision. But even if it is legal, IDPs will not feel better. The state is obliged to provide social protection to the population regardless of their registration.
Let us remind, on March, 4, the regulation of the Cabinet of Ministers № 79 has amended the Procedure for formalizing and issuance of certificate about registering persons evacuated from the ATO area. This amendment provides for additional requirement to the above mentioned certificate – presence of stamp of a territorial division of the SMS about IDP’s registered residence.
