Disclosure of IDPs’ personal data is violation of the right to life – Ombudsman

Disclosure of personal data of internally displaced persons occurred as a result of the transfer of the authorities (Ministry of Finance of Ukraine) to a private company “Delta M Ukraine” violates not only the right to privacy, but also in the broad sense the right to life stated by Mikhail Chaplyga, the representative of the Ombudsman.
“In a broad sense, it is not only a violation of the right to privacy, but in general – the right to life. After all, the information that has now become available to persons of the Company, working on the territory of the Russian Federation as well, can be used for illegal purposes, constitute a threat to life and property of internally displaced persons, as their property is left on the uncontrolled territories, and relatives “, – said Mikhail Chaplyga.
Head of the Verkhovna Rada Committee on Human Rights, National Minorities and International Relations Hryhoriy Nemyria said that the committee has prepared a letter to the Prime Minister of Ukraine Vladimir Groisman, drawing his attention to the right of privacy while verifying IDPs.
“In our letter we ask the Prime Minister to instruct the relevant central executive authorities to prevent violations of the right to privacy, to stop illegal processing of IDPs’ personal data by “Delta M Ukraine” till 10 December and to inform the Committee on measures taken”, – Grigory Nemyrya admitted.
Earlier, the Commissioner on Human Rights Valeria in Verhovna Rada Lutkovska claimed the Finance Ministry had flouted the rights of citizens to privacy. This refers to a situation where internally displaced persons have started to receive calls from “Delta M Ukraine” on the phone numbers that they reported to the social protection authorities while taking their registration.
Employees of “Delta M Ukraine”, referring to the initiative of the Ministry of Finance of Ukraine congratulate them on the holiday season, asked to clarify the whereabouts of IDPs and other confidential information, in particular regarding the year, residency in the uncontrolled territory and place of actual residence. In this case, if an IDP refuses to provide the requested information, reportedly this will affect the implementation of the future social benefits.
After verification, the Ombudsman’s office found that the company “Delta M Ukraine” provides services for “phone verification” of citizens on the basis of a contract with the State Enterprise. Under the agreement, the company has transferred the specified “Delta M Ukraine” database “in compliance with personal data protection.”
The Ombudsman noted that in this way officials violated a national law (the Law “On Protection of Personal Data”), and the international obligations of Ukraine, in particular to liberalize the visa regime (one of the key conditions is to protect the right to privacy).
